BY ACCESSING, USING, VIEWING, TRANSMITTING, CACHING OR STORING THIS SITE OR ANY OF ITS SERVICES, FUNCTIONS, MATERIALS, OR CONTENTS, YOU SHALL BE DEEMED TO HAVE AGREED TO EACH AND ALL THE TERMS, CONDITIONS, AND NOTICES IN THIS SITE ("AGREEMENT") WITHOUT MODIFICATION. CERTAIN TERMS, INCLUDING BUT NOT LIMITED TO THE ARBITRATION CLAUSE AND CLASS ACTION WAIVER CLAUSE, MAY RESTRICT YOUR RIGHTS TO BRING A CLAIM IN A COURT OF LAW. If you are not an Authorized User, and if you do not agree to the terms of this Agreement, you may not use this Site, including without limitation to make a reservation, or download any Materials from it. The documents, data, information and other materials (collectively the "Material(s)") contained on the Web Site (the "Site") are provided by EXECUTIVE CAREER COACHING, exclusively for non-commercial, individual use by prospective and confirmedEXECUTIVE CAREER COACHING to inquire about or make travel reservations and related services and for no other purpose (collectively, “Authorized Users”).
AGREEMENT FOR USE. You warrant that you are at least 18 years of age and possess the legal authority to enter into this agreement and to use this Site in accordance with all terms and conditions herein. You agree to be financially responsible for all of your use of this Site (as well as for use of your account by others, including without limitation minors living with you). You agree to supervise all usage by minors of this Site under your name or account. You also warrant that all information supplied by you or members of your household in using this Site is true and accurate and without limitation, or any false or fraudulent reservation. You agree that the services of this Site shall be used only to make legitimate or purchases for you or for another person for whom you are legally authorized to act. You understand that overuse or abuse of the reservation facilities of this Site may result in your being denied access to such facilities.
COMMUNICATIONS: By creating an Account on our service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us at connect@executivecareercoaching.io. For text messages, reply STOP to any message to opt-out. Opt-out requests will be honored within 10 business days.
PURCHASES: If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. The service may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
REFUND POLICY: Digital products and services are non-refundable once the product or service has been delivered. If you are unsatisfied with a product or service, please contact us at connect@executivecareercoaching.io within 30 days of purchase to discuss potential remedies. We may, at our sole discretion, offer a refund, replacement, or credit on a case by case basis. Any refunds will be issued to the original payment method within 10 business days of an approved refund request.
SUBSCRIPTION
Billing Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set on a monthly basis. At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or Executive Career Coaching cancels it. You may cancel your Subscription renewal by contacting Executive Career Coaching customer support at connect@executivecareercoaching.io. A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide Executive Career Coaching with accurate and complete billing information including full name, address, state, zip code, telephone number, and valid payment method information. By submitting such payment information, you automatically authorize Executive Career Coaching to charge all Subscription fees incurred through your account to any such payment instruments. Should automatic billing fail to occur for any reason, Executive Career Coaching will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
IMPORTANT NOTICE ABOUT RECURRING CHARGES: By purchasing a subscription product or service, you agree that your subscription will be automatically renewed at the end of each billing period until you cancel. Your account will be charged the subscription rate plus applicable taxes each billing period until cancellation. You may cancel at any time by logging into your account or contacting connect@executivecareercoaching.io. If you cancel, you will continue to have access for the remainder of the current billing period but will not be entitled to a refund of any portion of the fee.
FEE CHANGES: Executive Career Coaching, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Executive Career Coaching will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective. Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
USER CONDUCT: You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, "Content") that you submit, post or display on or via the Service. You agree not to provide infringing, obscene, threatening, or otherwise unlawful or offensive Content. You may not use the Service for any illegal or unauthorized purpose or violate any laws (including intellectual property laws and privacy laws).
THIRD-PARTY: We may display, include or make available third-party content (including data, information, applications and other products services and/or materials) or provide links to third-party websites or services ("Third-Party Services"). You acknowledge and agree that Executive Career Coaching shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, legality, decency, quality or any other aspect thereof. Executive Career Coaching does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.
EARNINGS AND INCOME DISCLAIMER: Through our Service and products, we provide 1:1 Executive Career and Group Coaching, Leadership development content, transformation strategies, information, and tools. However, individual success depends on many factors including your skills, knowledge, ability, dedication, business savvy, network, and financial situation. We do not guarantee that you will attain a particular result or earn success using our ideas, tools, strategies or recommendations. Nothing on our Sites is a promise or guarantee of earnings or income. Any examples of success of income earned by our customers is not to be interpreted as common, typical, expected, or normal. Your level of success in attaining the results claimed depends on the time you devote, the ideas and techniques you implement, your finances, knowledge, and various skills. No guarantees are made that you will achieve results similar to those featured in any case study or testimonial. If you rely upon any figures provided, you must accept the entire risk of not doing as well as the information provided. This applies whether the earnings or income examples are monetary in nature or pertain to advertising credits which may be earned (whether such credits are convertible to cash or not).

DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY: We provide our service using a commercially reasonable level of skill and care and we hope that you will enjoy using it. But there are certain things that we don't promise about our services.
Other than as expressly set out in these terms or additional terms, neither Executive Career Coaching nor its licensors, suppliers, advertisers, or distributors make any specific promises about the service. For example, we don´t make any commitments about the content within the service, the specific functions of the service, or their reliability, availability or ability to meet our needs. We provide the services “as is”.
To the extent permitted by law, Executive Career Coaching and its affiliates (and to the extent permitted by law, Executive Career Coaching and its affiliates (and associated service providers) will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damage.
To the extent permitted by law, the total liability of Executive Career Coaching and its affiliates (and associated service providers), for any claim under these terms, including for any implied warranties, is limited to the amount you paid us to use the services (or, we choose, to supplying you the services again). In all cases, Executive Career Coaching and its affiliates (and associated service providers) will not be liable for any loss or damage that is not reasonably foreseeable.
INDEMNIFICATION: You will indemnify and hold harmless Executive Career Coaching and its officers, directors, employee and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees arising out of or in any way connected with (i) your access to or use of the Service or (ii) your violation of these Terms.
GOVERNING LAW: The parties agree that this Terms of Service shall be governed by and construed in accordance with the law of Portugal and all disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Lisbon.
CHANGES TO TERMS: Executive Career Coaching reserves the right, in its sole discretion, to change the Terms under which the Service is offered. The most current version of the Terms will supersede all previous versions. Executive Career Coaching encourages you to periodically review the Terms to stay informed of our updates.
